In recent years the gaps between Coventry, Kenilworth and Leamington have narrowed considerably. Designating this gap an 'Area of Restraint' would ensure that the open nature is preserved and that the purposes of the green belt are maintained. It would have an opposite, positive effect to that of possible development in SGs 1-6. SG06 in particular is agricultural land with leisure benefits offered by the rural footpaths. It therefore has demonstrable community benefits as well as visual amenity and food production benefits. It also contributes greatly to the character of the settlements of Old Milverton and Blackdown.

Areas of Restraint are potentially a mechanism for protecting areas that contribute positively to heritage assets or well-preserved historic settlements. For example, where a settlement has a good medieval settlement form, the surrounding fields may contain further evidence of medieval settlement or associated field system. We therefore welcome the clarity that they will seek to protect areas that make an important contribution to the character of the settlement.
We also welcome that this policy is proposed to be consistent across both Stratford-on-Avon and Warwick districts.

We also note that further evidence is being produced to inform the landscape character of sites and is expected to be published with the Regulation 19. It is unclear whether new areas of restraint are being proposed in Warwick District and where these will be located. Therefore, the draft policy is not considered to be justified, as required in NPPF paragraph 36.

In the context of settlements in the CNL, this policy approach could help to conserve and enhance the natural beauty of the CNL. For settlements in the setting of the CNL, it could help to protect views looking towards the CNL (particularly views that feature the Cotswold escarpment and / or escarpment outliers).

Again, it is not clear how areas of restraint will differ from certain other forms of control identified elsewhere in the proposed DPDs or wider planning legislation, such as Local Green Spaces, conservation areas, open space networks and in the case of Warwick, green belt. Justification for its implementation should be made very clear in the policy along with an indication of support from national planning guidance and a robust justification based on how it will differ from other forms of local amenity protection.
