Open Space SPD
The Open Space Requirement for New Development
3.1 On all residential development there will be a requirement for open space provision in accordance with the standards specified in Appendix B of this SPD. The District Council will expect developers to meet the overall open space requirement; however it may apply a degree of flexibility to the individual types of space having regard to the Parks and Open Space Audit (2008) and the particular circumstances of the site.
3.2 Where it is considered impractical or inappropriate to provide open space in the form of a physical on-site contribution, the District Council will consider commuting the requirement to an alternative location within reasonable walking distance of the development.
3.3 Where an alternative location is not available or considered appropriate to serve the development, a financial contribution from the developer as an alternative means of providing qualitative improvements to existing open space will be required. The form of any contribution will be guided by the findings of the District's Parks and Open Spaces Audit (2008) and any other material evidence.
3.4 In instances where off-site financial contributions are proposed, the Council will endeavour to ensure that any quantitative or qualitative improvements that result are made within reasonable walking distance of the development. However, if qualitative improvements are not necessary, monies will be accrued into a central fund for strategic enhancements to open space across the District.
3.5 Where a developer makes the physical provision of new open space on-site or off-site which it wishes the District Council to adopt (subject to it meeting minimum size criteria), a legal agreement will be sought to lay out the identified area of land to an appropriate standard and stipulate any management regime required.
3.6 On appropriate commercial developments there will be a requirement for open space provision, having regard to the size and nature of the site and its intended use, the number of people who will regularly use the site, and the availability of alternative open space provision within reasonable walking distance of the site.
