There is nothing more which I can add at this stage to the original Core Strategy conformity opinion.
Further judgment cannot be made until you at the District Council consult on the next stage, after you have decided whether the inclusion of any of these potential allocations is warranted.
That is the stage at which we at WMLB could consider how these sites would relate to the District's Spatial Strategy and conformity with the Regional Strategy.
I am responding on behalf of West Midlands Leaders Board (WMLB) by e-mail in order to meet your consultation deadline of 09/04/10.
I have taken into careful account the advice which I have received from Warwickshire CC, which acts as our conformity advisors.
I note that the consultation focuses on alternative sites which have been put forward by developers and, as such, are not being promoted by the District Council. Therefore, I consider that there is nothing more which I can add at this stage to the original Core Strategy conformity opinion.
I cannot make a further judgment until you at the District Council consult on the next stage, after you have decided whether the inclusion of any of these potential allocations is warranted.
I consider that is the stage at which we at WMLB could consider how these sites would relate to the District's Spatial Strategy and conformity with the Regional Strategy ( which from April 2010 consists of the Regional Economic Strategy plus the January 2008 approved RSS and the as yet incomplete RSS Phase 2 Revision).

Due to the specific nature of the Trust's remit we are concerned with the protection and promotion of theatres and it is not part of The Theatres Trust's remit to comment on site allocations except to provide guidance on assessing the best locations for theatre provision in a town (preferably) which will support and protect sustainable theatre use. The Council should be satisfied that there is adequate provision for cultural facilities and that these are in easily accessible locations by public transport and road with adequate parking.
The Theatres Trust is The National Advisory Public Body for Theatres. The Town & Country Planning (General Development Procedure) Order 1995, Article 10, Para (v) requires the Trust to be consulted on planning applications which include 'development involving any land on which there is a theatre.' It was established by The Theatres Trust Act 1976 'to promote the better protection of theatres'. This applies to all theatre buildings, old and new, in current use, in other uses, or disused.

A detail habitat assessment should cover all of the alternative sites and should be supplemented by species and geological data. Any potential Local Wildlife/Geological Sites identified should be assessed against the relevant criteria prior to site selection.
Historic environment assessments should be carried out by appropriately qualified and experienced heritage professionals.
The Historic Landscape Character (HLC) of the sites and their surrounding areas should be taken into account during the assessments.

Evidence base
Up-to-date ecological, geological and historic environment information is essential to inform an evidence base to support this document.
Ecology & geology
Whilst we acknowledge and support the work which was undertaken via the Warwick District Habitat Assessment 2008 to form part of the evidence base for the core strategy, we also note that this work only covers some of the proposed sites within this document, whilst others are not covered at all.
We would therefore recommend that this detailed habitat assessment is extended to cover all of the Alternative Sites in full and is also supplemented by species and geological data. We would also recommend that any potential Local Wildlife/Geological Sites identified within the site boundaries are assessed against the relevant criteria prior to site selection.
Historic environment
In addition to the above, we would recommend that historic environment assessments be carried out of the proposed Alternative Sites by appropriately qualified and experienced heritage professionals. The Historic Landscape Character (HLC) of the sites and their surrounding areas should be taken into account during the assessments.

A detailed appraisal of all options in respect of the natural and historic environment needs to be undertaken in order to provide a robust evidence base for decision-making. The same level of detail given to sites in the preferred options is needed for these sites to make a sound assessment.
It is strongly recommended that Warwick District Council produce a screening report as soon as feasible regarding the possible requirement undertake a Habitats Regulations Assessment (HRA) of the draft core strategy.
The Evidence Base.
Page 20 of PPS12 states that the Core Strategy must be justified and goes on to say that the document must be founded on a 'robust and credible evidence base'. To be robust and credible, the information must be up-to-date and this may be tested when the Core Strategy comes to the examination in public stage.
A detailed appraisal of all options in respect of the natural and historic environment needs to be undertaken in order to provide a robust evidence base for decision-making.
Natural England welcomed the Warwick District Habitat Assessment carried out by the HBA project as part of the evidence base for the initial tranche of sites in the core strategy preferred options consultation. However, the same level of detail has not been available in full for the alternative sites proposed for the current consultation in order to enable a full appraisal of each option. We recommend that the HBA habitat assessment is extended to include all the proposed alternative sites. In addition to this we recommend that species, geological and landscape data should be screened from existing Warwickshire Local Record Centre data to complement the habitat data and the additional survey work that has been recommended within the Warwick District Habitat Assessment, such as potential Local Wildlife/Geological Site criteria assessments are undertaken prior to site selection.
Notwithstanding the points above, in terms of proximity to statutorily protected sites our initial comments are to note that Loes Farm, Guy's Cliffe is within 1km of Guy's Cliffe geological SSSI and Land at Baginton is about 2Km from Ryton and Brandon Gravel pits SSSI. Any possible indirect impacts should be evaluated.
Habitat Regulations Assessment (HRA)
As stated in our response to the core strategy preferred options consultation on the 24th September 2009, it is strongly recommended that Warwick District Council produce a screening report as soon as feasible regarding the possible requirement undertake a Habitats Regulations Assessment (HRA) of the draft core strategy. This is a requirement of regulation 85 of the Conservation (Natural Habitats &c.) (Amendment) Regulations (2007) which applies to the preparation of land use plans. The purpose of the assessment is to consider if the Core Strategy is likely to cause any significant adverse effects on the nature conservation interests of statutorily designated European protected sites in the vicinity of the District, alone and/or in-combination. Natural England will be happy to advise on how this screening should be undertaken. We attach a report detailing possible threats to the conservation objectives of SAC/SPAs in the West Midlands that may be of assistance.
