Thank you for your email of the 20 July 2012 regarding the above.

The proposed area is outside of the currently defined coalfield; therefore The Coal
Authority has no specific comments to make on the proposed area.

In the spirit of ensuring efficient use of resources and proportionality it will not be
necessary for The Coal Authority to receive with any future consultation drafts or updates.

The Coal Authority wishes the Bishop's Tachbrook Parish Council every success with the preparation of the Neighbourhood Plan.

I received an email on 20 July 2012, seeking comments on the application by Bishop's Tachbrook Parish Council for designation of a Neighbourhood Plan Area.

The Health and Safety Executive (HSE) is a statutory consultee for certain developments within the consultation distance of major hazard sites and major accident hazard pipelines.
Within the area identified in the Neighbourhood Plan Area for Bishop's Tachbrook, there is a major accident hazard pipeline operated by National Grid Gas plc (Ref. 1453 - Feeder 14 Churchover/Wormington).
HSE should be consulted over any relevant developments which lie within 210 metres either side of this pipeline, and the following consultation zones apply to this pipeline:
Inner zone = 55 metres
Middle zone = 170 metres
Outer zone = 210 metres
Warwick District Council should have details of the pipeline route, as the pipeline operator is required to provided these to the relevant local authorities for emergency planning purposes.

When potential development sites are identified, if any of them lie within the above consultation distance, Warwick District Council can use PADHI+, HSE's on-line decision support software tool, to see how HSE would advise on any proposed development.

We are instructructed by Mr Brian Lewis of Hill Farm, Banbury Road, Bishop's Tachbrook to comment on the application made by BTPC for the designation of a Neighbourhood Area.

We note that the application propses to set the area boundary as the ward boundary of the parish of Bishop's Tachbrook. We support this approach.

The application states that the forthcoming Neighbourhood Plan will aim to balance the needs of both the populated and rural parts of the area. We concur with this but note that the Plan should also accord with the emerging Core Strategy and allocate sufficient land for housing and other forms of development to meet the overall development requirements of the District.

Mr Lewis would welcome the opportunity to participate in the process.

The Preferred Options development site known as 'South of Gallows Hill/West of Europa Way' should be omitted from the Neighbourhood Area.
The land in question is to meet the whole district and not a matter for the NP.
Progress on the NP should not be at the expense of the wider debate about expansion of the District.
Cites experience of Dawlish NP where conflicts with emerging Core Strategy meant the NP was found unsound.
May raise unrealistic expectations about the NP dealing with a strategic site.
Any proposal in NP for the area would be subservient to Local Plan proposals.

Representation Summary:

Land at Grove Farm and former Sewage Works, South of Harbury Lane should be omitted from the Neighbourhood Area.

The Parish Council's Neighbourhood Area application statement and expectations are inconsistent with an appropriate strategy for the district and the NPPF and it may attempt to prejudge the outcome of the Local Plan.

There are key strategic issues in terms of level and location of growth that still need to be properly assessed.

Justification for including the whole parish is not clear.

Any proposals by the Parish Council to pursue a Neighbourhood Plan are premature.
