It is noted that Draft Policy Direction 38 stipulates exploring a requirement for a higher percentage of Biodiversity Net Gain than the minimum 10% mandatory requirement. Barratt David Wilson Homes Mercia contends that the SWLP should not be including a Policy which requires more than 10% gain without the appropriate justification, including in relation to assessment of the impact of such a requirement on the ability and viability of delivery the required new homes in the most sustainable locations. This justification is required by the NPPF14 and currently does not exist.
In addition, experience is already showing that many sites proposed for housing will require off-site BNG which will have an effect on the viability of the development. Furthermore the provision of 10% BNG onsite is being found to reduce the number of homes a site can support. A requirement for more than 10% BNG is likely to require the Councils to allocate more sites for homes and employment development. If the Councils wish to genuinely ensure the efficient use of land for housing, and other development, then they should not require BNG to be more than 10%.
